CJC Report: Procedure for Determining Mental Capacity in Civil Proceedings

The Civil Justice Council has published its final report on the Procedure for Determining Mental Capacity in Civil Proceedings. Read the report here.
 
Sir Geoffrey Vos, Master of the Rolls, Head of Civil Justice and Chair of the CJC, said: “I am grateful to co-chairs Diane Astin and Daniel Clarke and their working group for this ground-breaking report. This work goes to the heart of the CJC’s raison d’être. Tackling the issue of mental capacity of litigants in our courts will help make the civil justice system more accessible, fair and efficient.

“In many ways, this report is only the beginning. I very much hope that all stakeholders will look carefully at the recommendations. I look forward to the CJC’s review of the recommendations after enough time has passed for their effect to be assessed.”
